Membre élu ou désigné au CSE, il faut choisir

Deux salariés sont élus en qualité de membre suppléant au CSE de leur entreprise. Par la suite, ils sont également désignés, chacun par un syndicat, en qualité de représentant syndical au sein de ce même CSE.

L’employeur conteste cette désignation. Selon lui, la fonction de représentant syndical au sein du CSE est incompatible avec la fonction de membre élu. Les salariés doivent donc opter pour l’un des 2 mandats.

Ce que confirme le juge : il souligne, en effet, qu’un salarié ne peut pas siéger simultanément dans le même CSE en qualité à la fois de membre élu (titulaire ou suppléant) et de représentant syndical.

Il justifie cela par le fait que le salarié ne peut, au sein d’une même instance et dans le même temps, exercer les fonctions délibératives du membre élu et les fonctions consultatives liées à son mandat de représentant syndical. Notez, à ce sujet, qu’aucun accord collectif ne peut déroger à cette règle de non-cumul des mandats.

A défaut d’option par le salarié, son mandat de représentant syndical au sein du CSE devient caduc.
