La propriétaire d’une maison détruite va demander à la Mairie l’autorisation de la reconstruire à l’identique, ce qui lui est refusé à 3 reprises. Elle va alors faire reconstruire sa maison sans autorisation estimant bénéficier d’un « droit à la reconstruction ». A-t-elle raison ?


Maison détruite : un droit à la reconstruction ?

Parce que sa maison est détruite par un incendie, une propriétaire dépose un permis de construire en mairie, puis un deuxième, puis un troisième… tous refusés !

La propriétaire décide de passer outre ces refus, sans chercher à les contester, et fait reconstruire à l’identique sa maison.

Parce que cette reconstruction s’est faite sans son accord, la Mairie réclame la démolition de la maison et engage, pour cela, une procédure judiciaire… 7 ans plus tard !

Une démolition à laquelle refuse de procéder la propriétaire :

  • les refus de permis de construire sont injustifiés et, de toute façon, elle estime n’avoir pas besoin d’une autorisation de construire pour reconstruire à l’identique une maison détruite par un incendie ;
  • la Mairie a mis 7 ans à engager une action en justice à son encontre ; compte tenu du délai écoulé, elle estime que la Mairie a tacitement toléré la reconstruction de sa maison.

Arguments que la Mairie conteste :

  • pour reconstruire sa maison, la propriétaire a nécessairement besoin d’un permis de construire ;
  • les refus de permis de construire sont justifiés car la maison est classée dans une zone rouge inondable, ce dont la propriétaire a été informée lors de l’achat de la maison, 2 ans avant l’incendie ;
  • l’action en démolition peut être exercée dans un délai de 10 ans : en agissant au bout de 7 ans, la Mairie a donc exercé son action dans le délai imparti.

Ce que confirme le juge, qui ordonne la démolition de la maison.
