Sociétés agricoles : du nouveau en matière de droits d’enregistrement

  • Pour les ventes de parts de sociétés civiles

Actuellement, les ventes de parts de GAEC (groupement agricole d’exploitation en commun) et d’EARL (exploitation agricole à responsabilité limitée) sont soumises à la formalité de l’enregistrement et donnent lieu au paiement d’un droit fixe de 125 €.

Depuis le 1er janvier 2020, les ventes de parts de sociétés civiles à objet principalement agricole soumises à la formalité de l’enregistrement donnent lieu, elles aussi, au paiement d’un droit fixe de 125 €, sous réserve que les sociétés en question soient constituées depuis au moins 3 ans au jour de la vente.

  • Pour les achats de titres dans le cadre du rachat d’une entreprise par ses salariés

Jusqu’à présent, les achats de titres ou de parts sociales réalisés dans le cadre du rachat d’une entreprise par ses salariés sont exonérés de droits d’enregistrement.

Il est prévu que cette exonération prenne fin le 31 décembre 2022.
