Si vous proposez en location un logement meublé sur des plateformes Web de type « Airbnb », sachez que la Loi Engagement et Proximité comporte quelques mesures que vous devez (impérativement) connaître…


Loi Engagement et Proximité : une durée de location « Airbnb » limitée

Actuellement, les locations de type « Airbnb »ne peuvent pas excéder 120 jours/an sur le territoire des collectivités ayant instauré une procédure d’enregistrement de ces hébergements afin d’en assurer le contrôle.

Depuis le 29 décembre 2019, les mairies peuvent limiter la durée de ces locations entre 60 et 120 jours au cours d’une même année civile.


Loi Engagement et Proximité : création d’une procédure d’autorisation de mise en location « Airbnb »

Dans des conditions fixées dans un Décret à venir, les communes ayant mis en place la procédure d’enregistrement pourront aussi prévoir la mise en place d’une procédure d’autorisation de location d’un local commercial en tant que meublé de tourisme.

Notez que si la demande porte sur des locaux pour lesquels une autorisation de « changement de destination » est obligatoire, celle-ci équivaut à la procédure d’autorisation de location d’un local commercial en tant que meublé de tourisme.

En cas de non-respect de ces dispositions, l’auteur de l’infraction encourt une amende d’un montant maximal de 25 000 €.


Loi Engagement et Proximité : une obligation (renforcée) d’information

Actuellement, les plateformes de types « Airbnb » ont l’obligation de rappeler, lorsqu’elles communiquent avec les Mairies qui ont mis en place la procédure d’enregistrement des hébergements mis en location :

  • l’adresse de l’hébergement ;
  • le numéro de déclaration affecté à l’hébergement.

Désormais, ces plateformes Web ont aussi l’obligation de rappeler le nom du loueur.

En outre, les Mairies peuvent dorénavant demander à ces plateformes Web de leur indiquer si l’hébergement proposé à la location constitue ou non la résidence principale du loueur.


Loi Engagement et Proximité : focus sur la location saisonnière

Dans des conditions fixées dans un Décret à venir, les offres de contrat et les contrats de location saisonnière devront indiquer si le loueur est un particulier ou un professionnel.
