L’administration fiscale refuse au propriétaire d’un local commercial le bénéfice de l’exonération de taxe foncière pour inexploitation : un refus justifié, selon elle, par le fait que le propriétaire n’utilise pas lui-même le local « à des fins commerciales ou industrielles ». A tort ou à raison ?


Dégrèvement de taxe foncière : un local exploité par le propriétaire lui-même ?

Le propriétaire d’un local commercial demande à bénéficier du dégrèvement de taxe foncière pour inexploitation, ce que lui refuse l’administration.

Elle rappelle, en effet, que pour pouvoir bénéficier de cet avantage fiscal, 2 conditions doivent être réunies :

  • l’immeuble doit être utilisé par le propriétaire à des fins commerciales ou industrielles ;
  • l’exploitation doit être interrompue du fait de circonstances indépendantes de la volonté du propriétaire.

Ici, si le propriétaire avait consenti une location gérance portant sur un fonds de commerce d’ébénisterie industrielle au profit d’une société, il a mis un terme à ce contrat pour conclure, avec la même société, un contrat de bail commercial portant uniquement sur le local d’exploitation.

Une situation qui fait dire à l’administration que le propriétaire ne peut pas être regardé comme utilisant lui-même l’immeuble à des fins commerciales ou industrielles, et qui lui permet de refuser le bénéfice du dégrèvement de taxe foncière.
