A la suite d’un licenciement, une salariée perçoit, outre diverses indemnités de licenciement, une indemnité de congés payés. Elle s’étonne de voir que, pour le calcul de cette indemnité, il n’est pas tenu compte de sa rémunération variable. Normal, répond l’employeur…


Indemnité de congés payés : le sort de la rémunération variable

Une salariée perçoit, outre sa rémunération, une rémunération variable composée de 2 éléments :

  • l’un en lien avec les résultats commerciaux généraux de la société prenant en compte son niveau de performance ;
  • l’autre en lien avec sa performance individuelle, déterminée sur la base des évaluations et des notes sur sa performance sur l’ensemble de l’année fiscale.

A la suite de son licenciement, et après vérification, elle s’aperçoit que cette rémunération variable n’est pas prise en compte pour le calcul de son indemnité de congés payés. Ce qui est normal, estime l’employeur…

… et confirme le juge qui constate que cette rémunération variable n’est pas affectée par la prise de congés payés. Elle n’entre donc pas dans le calcul de l’indemnité de congés payés.
