Un salarié est embauché en CDD pour remplacer une salariée absente pour maladie, absence qui s’est prolongée par un congé maternité et aux termes duquel le CDD a pris fin. Abusivement, selon le salarié remplaçant, pour qui le terme du CDD pour remplacement n’est pas clair… Et à raison semble-t-il…


CDD pour remplacement : un terme précis… ou imprécis ?

Un salarié a été embauché en contrat à durée déterminée un 12 mars, en remplacement d’une salariée en arrêt de maladie. Le congé de maladie de la salariée ayant été prolongé, la société et le salarié ont signé un avenant le 20 mars prévoyant que le contrat était renouvelé jusqu’au 10 avril.

Le 11 avril, ils ont signé un nouveau CDD pour le remplacement de la même salariée en congé de maternité, le terme étant fixé cette fois au 9 octobre.

Il est donc mis fin au CDD à cette date, mais le salarié constate toutefois que la salariée remplacée ayant, à l’issue de son congé de maternité, bénéficié d’un congé parental, l’employeur a engagé une salariée intérimaire pour la remplacer, à compter du 3 janvier suivant.

Or, le salarié a ressorti son contrat et rappelé que le CDD contenait une clause précise quant au terme du contrat : il était spécifié, certes, que le terme était fixé au 9 octobre, mais que dans l’hypothèse où l’absence de la salariée remplacée se prolongerait, le contrat se poursuivrait jusqu’au surlendemain du retour de l’intéressée qui constituerait le terme automatique de la relation contractuelle.

Concrètement, la salariée remplacée ayant bénéficié d’un congé maternité, il ne pouvait être mis fin au CDD le 9 octobre. CDD qui a donc été rompu abusivement souligne le juge…
