Suite à la COP21 et l’Accord de Paris, le Gouvernement a présenté un « Plan Climat ». Celui-ci se matérialise dans la Loi relative à l’énergie et au climat, publiée le 9 novembre 2019, qui comporte une mesure concernant spécifiquement les entreprises employant plus de 500 personnes (250 en Outre-Mer)…


Loi Energie et Climat : focus sur le bilan d’émission de gaz à effet de serre

Les sociétés employant plus de 500 personnes (250 en Outre-Mer) doivent établir un bilan de leurs émissions de gaz à effet de serre.

Ces sociétés doivent joindre à ce bilan un plan de transition pour réduire leurs émissions de gaz à effet de serre. Elles en sont toutefois dispensées lorsque les informations de ce plan figurent dans leur déclaration de performance extra-financière.

Par ailleurs, le non-respect des obligations liées à l’établissement du bilan de leurs émissions de gaz à effet de serre était jusqu’ici sanctionné par une amende ne pouvant pas excéder 1 500 €. Le montant de cette amende est porté à 10 000 € (20 000 € en cas de récidive) par la Loi Energie et Climat.

Ces dispositions entrent en vigueur le 9 novembre 2020.
