Le client d’un notaire met en cause la responsabilité de ce dernier, suite à l’échec d’un investissement immobilier. Il lui reproche notamment d’avoir manqué à son devoir de conseil… auquel il n’était pas ici tenu, rétorque le notaire. Que s’est-il passé ?


Notaire : le devoir de conseil n’est pas absolu !

Un investisseur achète un appartement dans un objectif de défiscalisation. Mais l’immeuble n’est pas achevé, le constructeur étant placé en liquidation judiciaire. Finalement, l’investisseur ne pourra pas bénéficier pas des avantages fiscaux attendus.

Une situation que l’investisseur va reprocher au notaire, qui doit alors l’indemniser pense-t-il : il estime que le professionnel du droit a manqué à son devoir conseil et de mise en garde contre le risque d’échec du programme immobilier.

Ce que conteste le notaire : si effectivement son devoir de conseil est très étendu, il n’est toutefois pas tenu par ce devoir en ce qui concerne l’appréciation de la solvabilité des parties à un contrat ou l’opportunité économique d’une opération.

Et le notaire considère ici que son client ne peut lui reprocher la mise en liquidation judiciaire du constructeur et, par voie de conséquence, un potentiel risque de voir l’opération immobilière en question ne pas aboutir.

Le juge fait le même raisonnement que le notaire et rejette, en conséquence, la demande d’indemnisation formulée par l’investisseur.
