Par principe, un salarié ne peut pas travailler plus de 6 jours par semaine, et le repos hebdomadaire doit être d’au moins 24 heures. Mais un salarié peut-il demander à travailler plus de 6 jours par semaine ?


Repos hebdomadaire : pas de modification en vue ?

Une députée a posé la question de savoir si, sur la base du volontariat, comme cela peut exister pour le travail le dimanche, un salarié pouvait travailler au-delà de 6 jours par semaine.

Elle explique cette demande par le fait que l’encadrement législatif du repos hebdomadaire peut contraindre certains travailleurs et cite, pour exemple, le cas des salariés à temps partiel qui peuvent rencontrer des difficultés pour compléter leur durée de travail hebdomadaire.

Et la réponse est négative : le Gouvernement n’envisage pas de modifier la législation actuelle.

Il précise, à ce sujet, que l’interdiction d’employer des salariés plus de 6 jours par semaine ne signifie pas qu’il est interdit d’occuper un salarié plus de 6 jours de suite. Le repos hebdomadaire est apprécié au sein de chaque semaine civile, et non au terme de six jours de travail consécutifs.

En pratique, cela signifie qu’un employeur disposant d’une dérogation au repos dominical pourrait accorder un repos hebdomadaire le lundi de la première semaine, puis le dimanche de la deuxième semaine, et donc faire travailler un salarié durant 12 jours consécutifs.
