Un salarié, en situation d’arrêt maladie, est licencié par son employeur. Convaincu que son licenciement est lié à son état de santé, et donc fondé sur un motif discriminatoire, il conteste ce licenciement. Mais encore faut-il prouver ce qu’il avance, lui rétorque l’employeur… qui a aussi des arguments à faire valoir…


Motifs de licenciement : une affaire de preuves…

Un salarié, en arrêt longue maladie pendant 8 mois, a fait l’objet d’un licenciement juste avant la fin de son arrêt et donc de reprendre son poste. Pour le salarié, cela ne fait aucun doute : son licenciement a été prononcé en raison de son état de santé.

Il demande donc l’annulation de son licenciement pour discrimination.

Mais l’employeur lui rappelle que, s’il s’estime lésé par une mesure discriminatoire, le salarié doit justifier des éléments de fait laissant supposer l’existence d’une discrimination. Et, contrairement à ce qu’avance le salarié, le seul fait que son licenciement soit intervenu durant une période d’arrêt de travail n’est pas de nature à établir que cette décision est liée à son état de santé.

Au contraire, rappelle l’employeur : son licenciement est fondé sur des griefs portant sur une période antérieure à son arrêt de travail, évoqués lors d’un entretien avec son supérieur hiérarchique antérieurement à cet arrêt de travail, comme cela est justement rapporté dans la lettre de licenciement.

Parce que l’employeur prouve que sa décision est justifiée par des éléments objectifs étrangers à toute discrimination, et parce le salarié ne présente pas d’éléments de fait laissant supposer l’existence d’une discrimination fondée sur son état de santé, le juge donne raison… à l’employeur !
