Prévoir dans le contrat de travail une affectation sur un autre poste : possible ?

Un médecin refuse le changement d’affectation que lui propose son employeur. Cependant, son contrat de travail prévoit la possibilité de l’affecter à tout emploi relevant de sa qualification dans tout service de la clinique. Et c’est précisément sur un emploi relevant de sa qualification que l’employeur envisageait de l’affecter. Son refus justifie donc son licenciement, d’après l’employeur.

Mais le salarié conteste : pour lui, il s’agit d’une modification de son contrat de travail dont le refus ne peut constituer une cause réelle et sérieuse de licenciement. Il rappelle, en effet, que la nature des fonctions que l’employeur souhaite lui affecter est complètement différente de celles qu’il exerçait jusqu’alors : il n’aurait plus la charge des patients et de leur suivi thérapeutique mais occuperait un poste administratif.

Ce que confirme le juge : cette mutation fonctionnelle ne constitue par un changement des conditions de travail mais une modification du contrat de travail que le salarié est en droit de refuser. Ce licenciement est donc injustifié.
