Une entreprise licencie un salarié. 2 mois plus tard, ils concluent une transaction par laquelle le salarié renonce, contre une indemnité, à toute contestation portant sur l’exécution ou la rupture du contrat.

Mais le salarié va finalement contester cette transaction au motif que son licenciement ne lui a pas été régulièrement notifié.

Ce que l’employeur conteste, à son tour : le licenciement lui a été notifié par courrier remis en main propre contre signature.

Sauf que le licenciement doit être notifié par lettre recommandée avec AR, lui rétorque le salarié.

Certes, convient l’employeur, mais ce formalisme ne s’impose que dans le but de prouver la date de rupture du contrat. Or, dans le cadre d’une notification par remise en main propre contre signature, la date de rupture est précisément établie.

Argument qui ne convainc pas le juge qui souligne que la transaction, conclue sans notification préalable du licenciement par lettre recommandée avec avis de réception, est nulle. Le salarié peut donc valablement contester son licenciement.
