Un bailleur délivre un congé avec refus de renouvellement du bail commercial à son locataire, un gérant hôtelier. Ce dernier conteste alors la validité du congé reçu, aucun motif de refus de renouvellement n’ayant été indiqué. Va-t-il obtenir gain de cause ?


Refus de renouvellement du bail commercial : à justifier ?

Une commune met en location un local lui appartenant, au profit d’un locataire qui y exerce une activité hôtelière. Des années plus tard, la commune notifie au locataire, via un huissier de justice, qu’elle refuse de renouveler le bail et lui donne congé au terme du bail en cours.

Cette notification ne comporte aucune indication de motif justifiant le refus de renouvellement, ni offre d’indemnité d’éviction.

Par courrier séparé, la commune va proposer au locataire une offre d’indemnité d’éviction de 40 000 €, proposition qui reste sans réponse.

Le locataire conteste toutefois la validité du congé en justice, constatant que la commune ne fait état d’aucun motif justifiant le refus de renouvellement du bail.

Le juge rappelle cependant qu’un bailleur est toujours en droit de refuser le renouvellement d’un bail, pour autant qu’il s’acquitte d’une indemnité d’éviction. Il ajoute, en outre, que le congé n’a pas à être spécialement motivé.
