Un supermarché informe le gérant d’un Food truck que son contrat ne sera pas renouvelé et qu’il doit libérer l’emplacement mis à sa disposition sur son parking. Le gérant réclame alors le versement d’une indemnité d’éviction… que le supermarché refuse de payer, et à raison manifestement : pourquoi ?


Emplacement loué par un Food truck = bail commercial ?

Un entrepreneur souhaite se lancer dans l’exploitation d’un Food truck. Pour cela, il a besoin de trouver un emplacement et se met d’accord avec un supermarché pour obtenir une place sur le parking : un contrat d’une durée d’un an, renouvelable, est alors signé entre eux.

4 ans plus tard, le supermarché informe l’entrepreneur qu’il refuse de renouveler l’occupation de son parking.

L’entrepreneur demande alors le versement d’une indemnité d’éviction, considérant que le contrat de location de l’emplacement du supermarché est soumis à la réglementation du statut des baux commerciaux, qui prévoit le versement de l’indemnité réclamée en cas de refus de renouvellement du bail signé.

Indemnité d’éviction que refuse de payer le supermarché : pour lui, le contrat signé est une autorisation d’occupation précaire, dérogatoire au statut des baux commerciaux. Pour preuve, l’entrepreneur :

  • ne pouvait exercer son activité que pendant les heures d’ouverture du supermarché ;
  • n’avait pas la maîtrise exclusive de l’emplacement mis à disposition ;
  • dépendait des infrastructures du supermarché pour l’exercice de son activité (les branchements électriques lui permettant d’exercer son activité se trouvaient dans un boîtier fermé dont il n’avait pas le libre accès et ses bouteilles de gaz étaient entreposées dans le supermarché).

Au vu de tous ces éléments, le juge donne raison au supermarché. Le contrat signé ne bénéficie pas des règles protectrices applicables aux baux commerciaux. L’entrepreneur n’a donc pas droit au versement d’une indemnité d’éviction.
