EHPAD et exonération de taxe d’habitation : public ou privé ?

Actuellement, les établissements d’hébergement de personnes âgées dépendantes (EHPAD) de statut public bénéficient d’une exonération totale de taxe d’habitation.

Bien qu’exerçant les mêmes missions, les EHPAD de statut privé, donc les établissements qui n’appartiennent pas à l’Etat (ou à une collectivité territoriale), ne peuvent pas prétendre à un tel avantage fiscal.

A l’occasion d’une question au Gouvernement, il a été demandé s’il était envisageable d’étendre cette exonération de taxe d’habitation aux EHPAD de statut privé.

La réponse est claire : c’est non ! Le Gouvernement rappelle, en effet, que les établissements privés dont il est question peuvent bénéficier d’une diminution du montant de leur taxe d’habitation (on parle de « dégrèvement » de taxe) égale à la somme des exonérations et dégrèvement dont auraient pu bénéficier leurs résidents s’ils avaient été personnellement soumis à taxation au 1er janvier.
