Suite à une transaction avec un organisme de sécurité sociale, un particulier perçoit une rente viagère destinée à compenser une incapacité totale permanente et demande, à ce titre, à bénéficier d’une exonération d’impôt sur le revenu.

Ce que lui refuse l’administration fiscale : cet avantage est réservé par la Loi aux rentes viagères qui sont accordées par décision de justice.

Ici, la rente viagère ne lui a pas été octroyée par un juge. Le particulier ne peut donc pas prétendre au bénéfice de l’exonération d’impôt sur le revenu.

« La Loi est injuste », répond le particulier qui s’adresse alors au juge suprême pour lui demander de mettre fin à la différence de traitement entre les rentes accordées par décision de justice et celles accordées dans le cadre d’une transaction.

Et le juge confirme la position du particulier : la différence de traitement mise en place par la Loi n’a pas lieu d’être.

Dès lors, depuis le 24 novembre 2018, les personnes bénéficiant d’une rente viagère transactionnelle destinées à compenser une incapacité totale permanente pourront bénéficier de l’exonération d’impôt sur le revenu, au même titre que celles bénéficiant d’une rente viagère attribuée par un juge.
