La réglementation des ICPE soumises à autorisation met à la charge du vendeur une obligation d’information spécifique. C’est ce que va rappeler une société à un industriel qui, après avoir appris que les terrains achetés étaient pollués, réclame des indemnités. Pourtant, elle ne va pas obtenir gain de cause : pourquoi ?


Industriel : les terrains vendus sont-ils soumis à la réglementation des ICPE ?

Un industriel possède un site sur lequel est exploitée une installation classée pour la protection de l’environnement (ICPE) soumise à autorisation. L’industriel vend plusieurs parcelles se trouvant sur ce site à une société. Quelques années plus tard, à l’occasion d’une opération de réaménagement, la société découvre l’existence d’une pollution du sol sur les terrains vendus.

Mécontente, elle réclame des indemnités à l’industriel. La société rappelle alors que lorsqu’une ICPE soumise à autorisation a été exploitée sur un terrain, le vendeur de ce terrain est tenu d’en informer par écrit l’acheteur. Ce que n’a pas fait ici l’industriel.

« C’est normal », répond celui-ci : l’ICPE soumise à autorisation ne concernait les terrains vendus, non compris dans son périmètre. Il n’était donc pas tenu par l’obligation d’information relative à la réglementation des ICPE à l’égard de la société.

En outre, l’industriel rappelle que la société ne démontre pas qu’il avait connaissance, lors de de la vente, de l’existence d’une pollution du sol des terrains vendus, ni qu’il aurait volontairement dissimulé cette information. D’ailleurs, plusieurs rapports ne parviennent pas à établir la date d’apparition de la pollution des sols et l’origine de cette pollution.

Et pour le juge, l’industriel a raison : la demande d’indemnités formulée par la société est donc rejetée, aucune faute n’ayant été commise par l’industriel.
