Parce qu’elles peuvent entraîner des conséquences dramatiques en cas d’accidents ou d’incidents, les installations classées pour la protection de l’environnement (ICPE) ont l’obligation de déclarer ce type d’évènement au plus vite pour une meilleure gestion des conséquences. Pour rappel, en cas d’accident ou d’incident survenu du fait du fonctionnement d’une ICPE, son exploitant doit déclarer, dans les meilleurs délais, à l’inspection des installations classées les évènements en question qui sont de nature à porter atteinte aux intérêts protégés par la loi, notamment la santé, la sécurité, la salubrité publiques, l’agriculture, la protection de la nature, de l’environnement, la conservation des sites et des monuments, etc.

Cette déclaration doit, le cas échéant, être complétée par un rapport.

Notez que cette règle est applicable aux ICPE soumises à autorisation, à enregistrement ou à déclaration.

Depuis le 8 octobre 2025, les exploitants confrontés à ces situations pouvaient réaliser la déclaration en ligne. À partir du 1er janvier 2026, l’utilisation de ce service en ligne sera obligatoire dans certains cas.

Concrètement, un incident ou un accident devra obligatoirement être déclaré en ligne lorsque les conditions suivantes seront remplies :

  • l’évènement a lieu au sein d’une ICPE ;
  • l’évènement ne relève pas d’un accident du travail, sauf si l’accident du travail est directement lié au phénomène ;
  • l’évènement relève d’un risque accidentel lié à un phénomène dangereux (rejet imprévu de substances dangereuses ou polluantes, incendie, combustion, explosion) ou à une perturbation (atteinte de l’intégrité d’un équipement ou choc d’une faune volante sur une éolienne terrestre) ;
  • l’évènement est terminé.
