Lorsqu’un compromis de vente d’un logement situé en copropriété ne fait pas état du certificat « Loi Carrez », alors qu’il le devrait, est-il possible de régulariser ce manquement ? Un juge vient de répondre à cette question…


Certificat « Loi Carrez » : une absence régularisable ?

Plusieurs propriétaires d’un appartement, dont ils ont hérité, signent un compromis de vente avec un couple. Le certificat « Loi Carrez », qui mentionne la superficie privative de l’appartement, manque au compromis de vente. Dans les jours qui suivent la signature du compromis de vente, et pour régulariser la situation, le certificat « Loi Carrez » est signé par le couple, qui appose sur le document la formule « pris connaissance ».

Mais par la suite, le couple refuse de finaliser la vente et ne signe pas l’acte authentique chez le notaire.

Pour justifier son refus, le couple rappelle que la loi impose que le certificat « Loi Carrez soit annexé au compromis de vente pour un logement situé en copropriété et qu’il soit signé par le vendeur. A défaut, le compromis est nul.

Et le couple se retranche derrière cette nullité pour refuser de finaliser la vente. A tort, toutefois, selon les héritiers : parce que le compromis de vente a été régularisé suite à la signature du certificat « Loi Carrez » par le couple, il n’est plus possible d’invoquer la nullité qui affectait initialement le compromis.

Sauf que seule la signature de l’acte authentique de vente, comportant la mention de la surface privative de l’appartement, peut régulariser le compromis de vente. Dès lors, en refusant de finaliser la vente, le couple a toujours le droit de réclamer la nullité du compromis de vente, en se prévalant de l’absence, dans ce compromis, de la mention de la surface privative de l’appartement. Le couple peut donc légitimement refuser d’acheter la maison.
