Faisant face à d’importantes difficultés économiques, une entreprise propose à une salariée un contrat de sécurisation professionnelle, puis des reclassements. Mais, estimant que l’employeur ne lui a pas laissé assez de temps pour réfléchir aux propositions de reclassement, elle considère qu’il a manqué à cette obligation de reclassement. Verdict ?


Contrat de sécurisation professionnelle acceptée = refus de reclassement ?

Une entreprise rencontre des difficultés économiques telles qu’elle envisage le licenciement d’une salariée.

L’employeur convoque alors cette salariée à un entretien préalable à un licenciement et lui propose un contrat de sécurisation professionnelle, puis des reclassements pour lesquels il lui laisse un délai d’un mois.

Mais la salariée adhère au contrat de sécurisation professionnelle (CSP)… entraînant la rupture de son contrat de travail à l’expiration du délai légal de 21 jours suivant l’entretien au cours duquel le CSP lui a été proposé.

Sauf que le délai dont elle disposait pour se prononcer sur les reclassements n’est pas encore expiré. En rompant le contrat de travail avant l’expiration de ce délai, l’employeur a manqué à son obligation de reclassement, estime la salariée. Selon elle, la rupture de son contrat constitue donc un licenciement abusif.

Pas du tout, lui répond le juge : l’adhésion au CSP emporte non seulement la rupture du contrat de travail, mais également la renonciation aux propositions de reclassement. La rupture du contrat de travail est donc parfaitement valide.
