Une entreprise met en place l’intéressement et la participation aux résultats. Mais, pour le calcul des sommes à verser aux salariés, elle tient compte de leurs absences… notamment liées à leur participation à la grève. Les salariés grévistes y voient là une discrimination. A tort ou à raison ?


Intéressement, participation : déduire les absences ?

Une entreprise verse à ses salariés des sommes correspondant à l’intéressement et à la participation aux résultats de l’entreprise. Montant insuffisant, constatent certains salariés, puisque l’employeur a déduit leurs absences consécutives à un mouvement de grève. Ils y voient donc là une discrimination.

Ce que conteste l’employeur : selon lui, il est possible de prendre en compte toute absence non assimilée à du temps de travail effectif pour le paiement de l’intéressement, de la participation ou même d’un 13ème mois.

Et c’est bien là la subtilité, confirme le juge : s’il est possible de déduire toute absence non assimilée à du temps de travail effectif, toutes ces absences doivent entraîner les mêmes conséquences.

Or, il constate que les absences d’au moins 6 mois pour maladie non-professionnelle (qui, pour rappel, ne sont pas légalement assimilées à du temps de travail effectif) sont ici assimilées, pour l’intéressement et la participation, à du temps de travail effectif dans la limite de 12 mois : elles n’entraînent, par conséquent, aucune diminution des sommes versées au titre de l’intéressement et de la participation.

Les accords d’intéressement et de participation qui ne prennent en compte que certaines absences pour le calcul des sommes à verser sont donc discriminatoires.
