Un particulier fait le choix d’investir en Outre-mer, par l’intermédiaire d’une société, dans l’achat de tractopelles. Une fois cet investissement réalisé, il demande à bénéficier du dispositif Girardin afin de réduire le montant de son impôt sur le revenu, ce que l’administration lui refuse, considérant que le matériel acheté est usagé. A tort ou à raison ?

Pour obtenir une réduction d’impôt dans le cadre d’un investissement Outre-mer, un particulier investit, par l’intermédiaire d’une société soumise à l’impôt sur le revenu dont il est associé, dans l’achat de plusieurs tractopelles.

L’affaire sera donc rejugée sur ce point… pour déterminer si oui ou non, les tractopelles sont usagés !
