Dans le cadre d’un groupe de sociétés, il est mis en place un accord définissant les conditions dans lesquelles des avances pourront être obtenues par les filiales auprès de leur société holding.

Une de ces sociétés filiales perçoit justement des fonds de sa société holding, lesquels seront rémunérés au taux de 8,28 %. Un trop bien trop élevé pour l’administration fiscale qui rappelle que le taux rémunérant les avances en compte courant ne peut pas excéder :

  • le taux dit « fiscal » (qui correspond à la moyenne annuelle des taux effectifs moyens pratiqués par les établissements de crédit pour des prêts à taux variable aux entreprises, d’une durée initiale supérieure à deux ans) ;
  • ou, entre entreprises liées, le taux qu’il est possible d’obtenir d’établissements ou d’organismes financiers indépendants dans des conditions analogues.
