Un acquéreur obtient l’annulation de l’achat d’un terrain à bâtir. Une faute du notaire pour manquement à son obligation d’information est alors révélée. Ce qui amène la banque qui a financé l’opération à réclamer des indemnités… « Quel est votre préjudice ? » répond alors le notaire à la banque…


Notaire : vous pouvez devoir indemniser la banque…

Un notaire rédige un acte authentique de vente d’un terrain à bâtir. Mais l’acquéreur ne peut pas réaliser son projet de construction, le terrain étant situé en zone inondable par un arrêté préfectoral. Mécontent, l’acquéreur réclame et obtient l’annulation de la vente, le contrat de prêt bancaire conclu pour financer l’achat et la construction étant alors aussi annulé.

A l’occasion de ce litige, une faute du notaire pour manquement à son obligation d’information est retenue à l’encontre de ce dernier. La banque qui a octroyé un prêt à l’acquéreur réclame alors des indemnités au notaire : elle explique qu’elle a droit à des indemnités pour la perte de chance d’obtenir une rémunération du prêt bancaire consenti par la faute du notaire (en clair, les intérêts).

Mais le notaire estime qu’il n’a pas à indemniser la banque : la vente étant annulée, les sommes prêtées ont été reversées à la banque qui n’a donc subi aucun préjudice.

Mais pour le juge, la banque a effectivement subi un préjudice et a droit à des indemnités pour la perte de chance d’obtenir les intérêts à échoir.
