Une majoration du quotient familial sous réserve de vivre « sous le même toit »…

La règle est la suivante : tout contribuable peut considérer comme étant à sa charge, à la condition qu’elles vivent sous son toit, les personnes titulaires de la carte d’invalidité, avec pour conséquence une majoration du quotient familial.

Mais que faut-il entendre par « vivre sous le même toit » ?

En principe, la condition de vie sous le même toit à laquelle est subordonné le bénéfice d’une majoration du quotient familial pour prise à sa charge d’une personne invalide correspond à l’accueil à domicile d’une personne invalide. Cette condition de vie commune est aussi respectée lorsque c’est le contribuable qui habite chez la personne invalide.

Mais, en pratique, il faut aussi regarder les conditions d’hébergement, spécialement en cas d’occupation d’un même immeuble, au regard de son agencement.

C’est exactement ce qui s’est passé dans une affaire un peu particulière, dans laquelle un neveu habitait un appartement situé dans le même immeuble que celui de sa tante invalide, et qui a demandé le bénéfice de la majoration du quotient familial.

Pour lui, la condition de vie sous le même toit était respectée, mais l’administration ne l’a pas suivie dans son raisonnement et lui a refusé le bénéfice de la majoration de quotient familial.

Et pourtant le juge, qui a spécifiquement analysé l’agencement de l’immeuble, le lui a accordé : les appartements occupés par le neveu et la tante étaient communicants, et un ascenseur avait été installé pour que la tante puisse accéder à une cuisine installée au sous-sol qui était incluse dans les lots appartenant au neveu et qu’elle partageait avec lui.
