Assurance des dommages en cours de chantier : le client peut-il s’en prévaloir ?

Un propriétaire confie l’édification d’un hangar à une société de construction. Mais avant son achèvement, le hangar s’effondre sous l’effet d’une bourrasque.

Le propriétaire demande alors à l’assureur de la société, placée en liquidation judiciaire, de l’indemniser. Elle s’appuie, pour cela, sur une assurance garantissant les dommages en cours de chantier souscrite par la société de construction.

Mais l’assureur refuse de l’indemniser estimant que le propriétaire ne peut pas se prévaloir de cette assurance.

Il explique que la garantie en question couvre les dommages matériels subis en raison de l’effondrement de l’ouvrage construit avant sa réception, mais seulement au bénéfice exclusif de la société.

Par conséquent, un client de la société de construction n’est pas autorisé à exercer directement une action à son encontre en se prévalant de cette garantie. Ce que confirme le juge : l’assureur peut donc tout à fait refuser d’indemniser le propriétaire.
