Une association de formation professionnelle pour adultes se voit commander, pour une durée de 14 mois, une nouvelle formation par le conseil régional. Elle embauche donc une formatrice pour la dispenser… en CDD puisque la commande est limitée dans le temps. A tort ou à raison ?


Un surcroît d’activité n’est pas toujours « temporaire » !

Une association de formation professionnelle pour adultes propose habituellement 2 formations : l’une permettant de devenir plaquiste, l’autre permettant de devenir assistant de vie aux familles. Mais le conseil régional lui commande une nouvelle prestation de formation, pour une durée de 14 mois, afin de former au métier d’« assistant médico-social ».

L’association, qui ne disposait jusqu’alors que de 2 formateurs, sur les métiers de plaquiste et d’assistant de vie aux familles, doit alors embaucher un nouveau formateur « secrétaire médico-social ». Pour ce faire, elle recourt au CDD pour accroissement temporaire d’activité, pour une durée de 14 mois.

Quelques mois après la fin de la commande de cette formation, cette même association a organisé une formation d’assistant médico-social dédiée, cette fois, au marché privé, pour une durée de 7 mois. De quoi justifier, d’après la nouvelle salariée, que l’accroissement d’activité de l’association n’est pas temporaire, et que son CDD soit requalifié en CDI…

Ce que confirme le juge : le surcroît d’activité entraîné par la mise en place d’une nouvelle formation s’inscrit dans le cadre de l’activité normale et permanente de l’association et n’est pas temporaire. Le CDD doit donc effectivement être requalifié en CDI.
